These Terms and Conditions serve as a legally binding agreement between members of the Travelswapp platform and Travelswapp that govern the use of this website, pages, applications, and other aspects associated with Travelswapp and the Travelswapp platform.

The Travelswapp platform gives its members the right to host, explore, search, book vacations, and edit listings. All Members must list a house, apartment, or room to use the Travelswapp platform. Every member on our platform can be a host, and at some point if you swap, you will be a guest. Hosts provide housing to guest for a predetermined time frame which both parties agree on before traveling. Those that book and travel to another location, that is not considered their primary residence or a residence owned by them, are considered guests.

NOTICE

By accessing and/or joining Travelswapp.com you confirm that you have read and agree to the terms and conditions. You WILL NOT be able to book listings or access some perks of the platform until you have created a listing yourself. The Travelswapp platform is only for those that are looking to swap a house, apartment, or room with someone else who has a house, apartment, or room. If you do not have anything to swap you will not be able to use this platform. Travelswapp does not own, manage, or have any legal partnership/ties to any house, apartment, or room listed on the Travelswapp platform.

The Travelswapp mission is to give everyone a more affordable way to travel and explore new places without overpriced vacation housing while providing a trustworthy user friendly platform.

TERMS AND CONDITIONS

Hosting on Travelswapp

As a host on the Travelswapp platform it is your job to make sure your residence or the residence you are swapping is clean and up to Travelswapp standards. A host is someone or an organization that lists a house, apartment, or room on the Travelswapp platform. Everyone that has access to this platform can be a host.

Guest on Travelswapp

A guest is defined as anyone staying in a house, apartment, or room that is not owned by them or their primary residence.

Managing your listing

Hosts are responsible for managing their own listings which includes accepting and declining bookings. Changes made to your listing may require you to provide documentation showing that these changes are not false. Failure to provide this documentation after making changes, if requested, could result in removal from the platform.

By using the “list my Airbnb/Vrbo for me” link on the Travelswapp home page you are giving the Travelswapp team permission to use your Airbnb title, description, and pictures you created and took to create your listing on the travelswapp platform. By using this Travelswapp feature, you are claiming that the title, description, and pictures listed on your Airbnb listing were created and taken by you, and not Airbnb, and are giving the Travelswapp team permission to use this information without copyright infringement. Travelswapp will only create an account (username and password), add your Airbnb title, Airbnb description, and Airbnb pictures when creating your Travelswapp listing. All other listing information will need to be provided by you and you have to agree to the Travelswapp terms and conditions. The Travelswapp team can not do this for you.

Every member has the option to feature their listing so that their listing is shown near the top of the page. There are two ways to have your listing featured. If you swap frequently, three or more times per month, you will show up as a featured listing. The other way to have a featured listing is to pay a $5 fee per month. Having a listing that is featured allows other members to see your listing before other listings that are not featured. All featured listings will be grouped together.

Failure to Swap

Each swap involves two parties. When swapping a house, apartment, or room both parties are not required to swap. However, failure to swap occurs when both parties request a swap, one party completes a swap and the second party has not within 200 days of the first party swap date. If the second party decides not to swap within 200 days the failure to swap is settled. If the first party that has already completed the swap does not allow the second party to schedule a swap within 200 days this falls under failure to swap and the first party will be removed from the platform and required to pay additional inconvenience fees for the nights that the first party stayed at the second parties residence (up to $200 per night) for not providing the second party an opportunity to swap. Swaps do not have to take place at the same time and both parties do not have to swap but if both parties request a swap both parties must swap.

Canceling

Hosts and guests can cancel bookings that they previously made at any time OUTSIDE of the hosts “Booking Offset”, which gives hosts the opportunity to set how many days are required prior to the booking date. If a host or guest cancels within the “Booking Offset”, set by the host, the party that canceled is subject to a $100 cancellation fee. Repeated cancellations will result in removal from the platform.

Booking

Bookings can be made up to several months in advance, which is set by the host and known as “Booking Window”. “Booking Window” allows hosts to set how many days in advance a booking can be made. After swapping with another individual and confirming a specific booking date, we recommend that you do not change your booking dates. If both parties decide to change the booking dates, this process then falls under the canceling section. When booking a swap, the host and guest do not have to swap the same dates but it is important to confirm all specific dates in advance. After booking a swap, you will not have access to the hosts address. Full address information should be shared by hosts 3-5 days in advance of the expected swap date. It is up to hosts on when they provide guests the address to their residence but it must be at least 3 days in advance so guests can make travel arrangements.

Accepting and Declining Bookings

When a member requests to swap you will see this information under the “bookings” tab on your member page. To accept a booking, click on the booking then click “accept”. To decline a booking simply hit “decline”. Once you have made a decision, this information will be sent to the member that is attempting to swap. If there are any issues, members can always message each other on the Travelswapp platform or contact Travelswapp .

Travel Problems

If travel issues arise it is members responsibility to communicate with the person/organization you are swapping with. If a cancellation is required it then falls under the canceling section.

Membership Fees

Travelswapp requires all members to pay $20 per month to use the Travelswapp platform. You have the right to cancel this membership at any time, but it is members responsibility to cancel and you must do this through the Travelswapp platform.

Refund Policy

Travelswapp does not refund any monthly or yearly membership fees. For monthly and yearly membership fees it is the members responsibility to cancel before they are billed for the next month or year. Once purchased, yearly memberships will not be refunded even if you stop using the platform.

Reviews

Travelswapp is a privately owned platform, therefore, we have the right to remove inappropriate content from the reviews section. Some members make their decision to swap with an individual based on reviews so we want members to be honest when it comes to both negative and positive reviews but we want this to be done in a professional manner. All false/fake reviews will be removed immediately by the Travelswapp team. Travelswapp has no tolerance for false/fake reviews and could evoke further corrective actions such as being removed from the platform.

Privacy & Personal Data Policy

By becoming a member of the Travelswapp platform you agree to list and provide information regarding your house, apartment, or room including a description, photos, location, and other information relevant to your listing. This information will be kept private but can be retrieved by the Travelswapp team and other members that you agree to swap with. Members that provide sensitive information on the Travelswapp platform, such as address information, understand all associated risks. Travelswapp can not guarantee that this information will not be breached and is not responsible for any information lost or accessed that results from such breach. If there is a breach, all parties involved will receive a notice and a plan, put together by the Travelswapp team, to resolve breach issues. Travelswapp understands that information provided and listed on the Travelswapp platform can be sensitive and we will make every effort to ensure this information is safe. Travelswapp agrees not to sell, offer, distribute, or give away any information related to members that use the Travelswapp platform.

Liability

Travelswapp is not financially or legally liable/responsible for any damages caused by Travelswapp platform members/users while swapping homes, apartments, and rooms. Travelswapp is in no way legally liable/responsible for any injury/injuries or death(s) that could occur during a swap. By agreeing to these terms and conditions, you release Travelswapp from all liability and acknowledge that Travelswapp is not responsible for the actions of individuals, including damages to personal property, threats, fraud, injuries, and even death(s). Furthermore, by using/joining the Travelswapp platform you are stating that you agree to the terms and conditions and that you, the member/user of the Travelswapp platform, are agreeing not to sue Travelswapp for the actions of individuals, including financial loss, injury/injuries or death(s).

Theft

Travelswapp is not responsible for any lost or stolen items from a house, apartment, or room of any host. However, Travelswapp does assess these claims and has the right to administer additional fees to guests for stolen or lost items and can pursue legal action. Hosts also have the right to pursue legal action for claims of theft.

Damages to Property

Travelswapp asks that if you are a guest of a house, apartment, or room that belongs to someone else, that you respect their property. Do not cause any damage to the property, house, apartment, or room in any way. All guests that damage property, houses, apartments, and/or rooms are subject to additional fees to compensate the host for the damages caused by the guest. Hosts may provide guests with rules they have created specifically for their house, apartment, or room. Travelswapp ask that you respect and follow the rules placed by hosts. Failure to abide by Travelswapp Terms and Conditions or rules placed before guests by hosts can result in extra fees and temporary or permanent ban from the Travelswapp platform.

Criminal Check

Rarely does Travelswapp perform criminal checks on hosts or members of the Travelswapp platform. However, if Travelswapp does decide to conduct a criminal check the member involved will be notified in advance. Travelswapp reserves the right to remove anyone from the Travelswapp platform with or without cause.

Disagreements & Complaints

Disagreements and complaints directed toward Travelswapp should be discussed in a professional manner. All complaints directed toward Travelswapp should be submitted through the online form “contact us”. If it involves the Terms and Conditions or the Travelswapp platform, this will be addressed by the Travelswapp team as issues arise. Disagreements and complaints between hosts and guests should also be discussed professionally. If it does not concern Travelswapp services or the Travelswapp platform these issues do not involve Travelswapp .

Travelswapps Role

Our job is to ensure that all operations of the Travelswapp platform run smoothly by making sure all features are functioning as designed. We will enforce all Terms and Conditions placed within the Terms and Conditions document and address issues as they arise. Travelswapp is not a real estate or insurance agency and does not act as one for any host or guest using the Travelswapp platform. Travelswapp pledges to verify members and listings to ensure that they meet Travelswapp standards and abide by everything listed in the Terms and Conditions to provide a great experience for members. However, Travelswapp can not guarantee that the platform does not contain false listings and/or hosts. Within the Travelswapp platform there are promo listings to provide a model that shows this platforms capabilities. These listing will not allow you to book.

Member Accounts

All members of the Travelswapp platform will have the ability to revise and manage their Travelswapp account at any time. Travelswapp is not responsible for managing member accounts. All information and listings placed on the platform by members must be correct, accurate, and updated as changes are made by hosts. Issues with accounts will be addressed by the Travelswapp team. Travelswapp has the right to remove any member, their information, or their listing from the Travelswapp platform at anytime without cause.

Insurance

Travelswapp does not currently offer insurance to cover property/residence damages or destruction that may occur during a swap. Insurance is important and members are responsible for acquiring their own insurance to cover their residence in case of property/residence damages or destruction. Members are not required to have their own insurance to use the platform.

Disclaimer

Travelswapp and its staff do not guarantee the existence, safety, satisfaction, legality, or conditions of any house, apartment, room, guest, third party, host, listing service or any listing on the Travelswapp platform. Travelswapp does require documentation, photo ID and utility bill or equivalent, as part of the proof of residence/ownership to list on the Travelswapp platform but it does not guarantee that identities are not false. Furthermore, Travelswapp does not guarantee verification to not be false as well as criminal checks and screenings of guests, hosts, or listings. Travelswapp also does not guarantee protection from service interruption. Travelswapp will address all issues as they arise to ensure that members have the best experience possible. If you host a house, apartment, or room on the Travelswapp platform, you are responsible for complying with your state and federal laws, rules, and regulations.

Verification Process

In order to use the Travelswapp platform, all members must be verified. The verification process requires hosts to submit proper documentation. Once this documentation is received and reviewed, members will then be able to host properties and access all features on the Travelswapp platform. Documentation required to be verified includes proof of ownership/residence, utility bill or equivalent, and a photo ID. All verified listings have a green checkmark. We require verification so that members of this platform are able to swap with confidence knowing that they have a place to stay while also increasing safety during swap/exchanges. However, we can not fully guarantee satisfaction and safety and accept no responsibility or liability for incidents that occur. There may be listings visible on the platform that have not been verified. Members/users of the Travelswapp platform will not be able to swap their listings prior to being verified. These listing could be demos or listings that may be verified in the future.

Listing Standards

Travelswapp reserves the right to remove any listings that are not acceptable. This includes homes, apartments, rooms, and/or properties that lack cleanliness and that are not maintained properly. If any residence looks to be in an undesirable condition, Travelswapp reserves the right to remove it from the Travelswapp platform based on photos, images, or any other evidence that shows that the residence is not maintained. If a residence looks vacant (excessive yard clutter, abandoned vehicles, severely overgrown grass) and/or the residence has severe damages on the inside or the outside it will be removed without a refund.

False Listings

All members will have to verify ownership of each house, apartment, and room they list on the Travelswapp platform to use all platform capabilities. It is common practice for Travelswapp staff to request verification of ownership through utility statements or other legal documentation. Travelswapp staff has the right to ask for this documentation in order for members to use the platform. Failure to provide this information will result in listing verification being denied and access to the Travelswapp platform and its features will be limited. All verified listings on the platform have a green checkmark. Note, there may be listings visible on the platform that are not verified. Members/users will not be able to swap with these listings until they are verified. These listings are for demo purposes or to showcase potential future listings. If Travelswapp concludes that a false listing has been placed on the platform, Travelswapp has the right to remove it and the user associated with the account without cause. Travelswapp considers all false listings fraudulent, in which most cases could lead to legal action involving local or federal law enforcement.

Guest Entry

As a guest you agree not to cause any harm to the hosts property when trying to enter for the first time. Every host will select a way to get the guest a key or combination to a key pad. Hosts are responsible for messaging key instructions or combinations to guests using the Travelswapp platform. Hosts have the option to provide a combination, store the key in a combination key box, hide a key, store for local key pick up, or perform a key swap in transit.

Proof of Ownership/Residence

All members of the Travelswapp platform are required to show proof of ownership/residence for any house, apartment, or room listed on the platform in order to have full access. Members/users will not be able to swap if documentation is not provided. If you sell, discontinue your lease, get evicted, or change residences it is your responsibility to remove your listing entirely. If you lease a house, apartment, or room you can swap on the Travelswapp platform, Travelswapp is not responsible if you violate your lease/rental agreement by placing your house, apartment, room on the Travelswapp platform.

Home Surveillance/Camera Policy

In order to preserve the privacy of all members that swap, Travelswapp.com does NOT ALLOW voice recorders or video/photo surveillance INSIDE homes, apartments, or rooms. Members/hosts must remove and disconnect ALL cameras, voice reorders, and/or video recorders INSIDE the hosts residence prior to the guests arrival. If members/hosts fail to comply with this policy, additional fees can be applied to the host along with legal action if warranted.

Travelswapp Affilates

Travelswapp offers an affiliate program that pays affiliates $10 per person that signs up for a monthly membership. This is a one time payment per person referred. How does it work? You, the affiliate, signs up for the affiliate program through the “Travelswapp Affiliates” page, then you refer people to the Travelswapp platform, they create an account and purchase a membership plan putting your name in the, “How did you hear about Travelswapp ” box, and we pay you. It is that simple.

Dispute Settlement

Both members and Travelswapp have the right to compensation in small claims court without an arbitrator. Before involving an arbitrator, members agree to notify the opposite party, in writing, 45 days in advance in an attempt to resolve the issue through Travelswapp in an informal manner. Communication between the involved parties and Travelswapp will be done via email and will include all names involved in the process. Be sure to include contact information, a description of the issue, and a proposed resolution to the issue. If the issue can not be resolved between the involved parties and Travelswapp , both parties agree not to pursue arbitration until after the 45 day time frame has expired. Members and Travelswapp mutually agree that any dispute regarding the Terms and Conditions, the Travelswapp platform, hosts, guests, comments, listings, or any other content located within the Travelswapp platform, if not settled informally, will be settled by formal arbitration. Arbitrators will decide whether arbitration can be commenced. By using the Travelswapp platform, you agree that all legal disputes and settlements are addressed by Travelswapp first and that Travelswapp staff, CEO, creator, founder, employees, content creators, outside partners, affiliates, and other associates can not be held responsible or liable and can not be prosecuted financially or criminally for any issues, disputes, or settlements that take place regarding Travelswapp or its platform.

Final Travelswapp Remarks

By using this platform, Travelswapp members understand that Travelswapp and its employees are not responsible for any criminal actions by members or swap participants, nor is Travelswapp responsible for damages/destruction to hosts houses, apartments, or rooms. Travelswapp is not responsible for any of the following (including but not limited to): illness, loss, disability, liability of any kind, personal injury, or even death that might occur to guests, hosts, or members while swapping or using the Travelswapp platform. Travelswapp is not responsible for any lost, stolen, or damaged items from any hosts house, apartment, or room. By accessing/joining the Travelswapp platform (Travelswapp.com), hosts, guests, and members agree that they have read the Terms and Conditions and agree to abide by the Terms and Conditions and rules/information placed herein. All members of the Travelswapp platform understand that Travelswapp has the right to remove anyone from the Travelswapp platform for violating the Terms and Conditions placed before all members and potential members. Travelswapp also has the right to remove members from the Travelswapp for other reasons outside of the Terms and Conditions that are deemed destructive or inappropriate by the Travelswapp team. By accessing/joining the Travelswapp platform as a visitor or member, you agree not to sue Travelswapp , its employees, its partners, its affiliates or anyone else associated with Travelswapp for any reason whether the issue is covered in the Terms and Conditions or not. You release Travelswapp of all liability and understand that Travelswapp is not responsible for claims, damages, losses, financial expenses, or any other fees from the misuse of the Travelswapp platform or participation in the services provided by Travelswapp and understand that Travelswapp is not responsible for injuries or even death as a result of using the platform, swapping, traveling etc.
